The District & County Labour & Social Security Bureaus, the District & County Industry & Commerce Administration Branches,

In order to further regulate Job agencies activities in the labour market and to facilitate the development of Job agencies, according to Shanghai Regulations of Agents, The Regulation of Labour Market Administration by the Ministry of Labour & Social Security and The Provisional Regulations of Shanghai Job Placement, the Circular on the Supervision of Profit-making Job Agencies in Shanghai Municipality is as the followings,

1. Profit-making Job Agencies refer to the companies, partnerships, private-owned enterprises and other economic entities established according to relevant laws and regulations and with the qualification of Job Placement (domestic services not included).

2. In addition to the requirements stipulated by relevant laws and regulations, entities that apply to establish Profit-making Job agencies should have Job Agents with the number in line with their business nature,

1) At least 5 Job Agents are required for the companies or the non-company Legal persons;
2) At least 2 Job Agents are required for the partnerships;
3) At least 1 Job Agent is required for the individual-invested Enterprises.

3. Entities that apply to establish Job agencies should apply for the Permit of Job Placement in the Shanghai Municipality with the Labour & Social Security Departments and go through business registration procedure with the Industry & Commerce Administration Departments.

4. In case of establishment of new branches by the Profit-making Job Agencies, the new branches shall have Job Agents with the number in line with their business nature, and the requirements of approval and business registration with respective Departments as per Article 3 of this Circular shall be met.

Any changes or alternation in the Profit-making Job Agencies, if within the same administrative district, shall be reported and approved by the original approval Departments, if beyond the original administrative districts, shall be approved by the original approval Departments, and the concerned Agencies shall complete the application and registration procedure of Profit-making Job Agencies in the new district.

In case of business termination, the Profit-making Job Agencies shall complete termination procedure with the original approval Departments and go through deregistration process with the Industry & Commerce Administration Departments.

5. Qualification for Job Placement shall be obtained through examination in Shanghai Municipality.

Examinations for the Qualification of Job Placement are jointly organized by the Shanghai Association of Professional Agents and Shanghai Society of Labour & Social Security. The Syllabus and requirements of the examination shall be reviewed by the Municipal Industry and Commerce Administration Bureau and the Municipal Labour & Social Security Bureau.

Candidates that passed the examination and obtained the certificate may apply for registration of Job agent with the Municipal Industry and Commerce Administration Bureau according to relevant laws and regulations. And Job placement activities shall start upon receipt of the Certificate of Professional Agent (for Job Placement).

6. Certificate of Professional Agent (for Job Placement) shall be reviewed every 2 years.

7. Profit-making Job Agencies shall be annually reviewed by the Industry & Commerce Administration Departments and the Municipal Labour & Social Security Bureau according to relevant regulations.

The Municipal Labour & Social Security Bureau shall keep the Municipal Industry & Commerce Administration Bureau informed of the situation on those Profit-making Job Agencies that have failed the annual review.
